Indonesia is also the third largest cigarette consumer in the world. Along withthe times, so that technology is growing, not all cigarette products today only use tobacco as raw material. There are lots of consumers nowadays who are switchingfrom conventional cigarettes to electric cigarettes or E-cigarettes. One of the products that are mostly found and consumed today is the Vape Cigarette, which isan innovation from conventional cigarettes to an electric cigarette which consists of two elements, namely suction device and liquid (refill/liquid) Electric cigarettesoffer many flavors that can be enjoyed. E-cigarettes are considered safer than regular cigarettes. However, it turns out that the risks of inhaling e-cigarettes are not much different from regular cigarettes. In a journal published by Circulation itis stated that high amounts of nanoparticles are found in e-cigarette vapor inhalers.In the absence of warning labels, hazard labels and standardization of e-cigarettessold by business actors, the rights of e-cigarette buyers/users as consumers have been violated, such as the right to comfort, security and safety in consuming goodsand/or services and the right to for correct, clear and honest information regardingthe conditions and guarantees of goods and/or services. the scope of smoking prohibited in smoke-free areas in statutory regulations is limited to people who smoke conventional cigarettes in accordance with the definition of cigarettes in theGovernment Regulation, the definition of cigarettes according to Government Regulation Number 109 of 2012 concerning Control of Substances Containing Addictive Substances in the Form of Tobacco Products for Health.
This research is a normative legal research. This is based on library researchwhich takes excerpts from reading books, or supporting books that have somethingto do with the problem to be studied. Source of data Primary, secondary and tertiarydata sources characterize this study. This study also used qualitative data analysisand produced descriptive data.
From the results of the research and discussion conducted, several conclusions were obtained, namely: First, regulations regarding electric cigarettes in Indonesia, both in terms of sales and use, do not yet have clear regulations regarding this matter. The connotation of cigarettes referred to in Indonesian laws and regulations is defined as conventional cigarettes. The only regulation on e- cigarettes in Indonesia is only regulated through the Regulation of the Minister of Trade of the Republic of Indonesia Number 86 of 2017 concerning Provisions for the Import of E-Cigarettes. There is no specific regulation regarding the ban on the use of electric cigarettes, which clearly also poses a danger, especially to public health rights which are protected by the Constitution. Second, the prohibition on the use or sale of cigarettes is a necessity that must be implemented. This urgency is defined as concrete and solution steps in creating a healthy environment and fulfilling the right to health for other communities. E-cigarettes clearly contain dangers that can damage the nation's generation, and therefore there needs to be regulation through the formation of laws regarding the prohibition of e-cigarettes.
