Implementasi Peraturan Mahkamah Agung Nomor 5 Tahun 2019 Tentang Pedoman Mengadili Permohonan Dispensasi Kawin Di Pengadilan Agama Pasir Pengaraian Kabupaten Rokan Hulu
Early marriage is still a social problem that occurs throughout Indonesia, including Rokan Hulu Regency. The existence of changes in the provisions for marriage dispensations by law gives the Court the authority to grant permission for marriage dispensations. With this legal relaxation, early marriages still often occur. This research aims to analyze the implementation of policy guidelines for adjudicating marriage dispensation applications at the Pasir Pengaraian Religious Court and the factors that influence the judge's consideration in granting permission for dispensation. The theory used is James E Anderson's theory of policy implementation. Namely, there are four indicators: policy implementer, nature of the administrative process, compliance with a policy, and the effect or impact of the policy. This research uses a descriptive qualitative study. The results of the research found that the implementation of the policy for adjudicating marriage dispensation applications at the Pasir Pengaraian Religious Court, Rokan Hulu Regency, has been implemented well in accordance with Supreme Court Regulation Number 5 of 2019 concerning guidelines for adjudicating marriage dispensation applications. The obstacle faced when implementing this policy is the public's ignorance regarding the implementation of this Supreme Court regulation. The factors that are taken into consideration by the judge in granting permission are the child's readiness both physically and psychologically based on the assessment test of the Social Service for Women's Empowerment and Child Protection, and it is deemed that no exploitation has occurred.
