Efektivitas Asean Treaty On Mutual Legal Assistance ( Amlat ) Dalam Menghadapi Kejahatan Transnasional Di Negara Indonesia

AMLAT was basically formed to deal with transnational crimes that occurred in ASEAN countries, and as the name suggests, transnational crimes, the perpetrators' operational area is the Southeast Asia region. Transnational criminal acts result in legal problems between one country and another country. So efforts to overcome and eradicate it are difficult to carry out without cooperation and harmonization of policies with other countries. Therefore, to overcome and eradicate it, good relations and cooperation between countries are needed.
The type of research used by researchers is normative legal research, using the theory of the principle of reciprocity and the principle of double criminality.
Cooperation between countries is needed to facilitate the handling of the process of investigation, prosecution and examination in court regarding a criminal matter that arises in both the Requesting Country and the Requested Country. In this case, it is increasingly important to feel the need for effective international cooperation regarding national and transnational crime problems. One type of international cooperation that can be used in law enforcement and can exchange information is criminal mutual assistance. The existence of MLA as an alternative and complementary instrument for extradition is increasingly relevant following the existence of the ASEAN Treaty on Mutual Legal Assistance in Criminal Matter 2004 (MLAT 2004) which has been signed by all ASEAN member countries. Previously, Indonesia itself had signed bilateral extradition agreements with Malaysia, the Philippines and Thailand, so that the existence of MLAT 2004 actually strengthened legal cooperation with other ASEAN member countries.
The conclusion that can be obtained from the results of this research is that MLA has the potential to be an effective tool in combating cross-border crime and promoting justice, as long as it is implemented well by member countries and monitored periodically for improvement, its effectiveness will continue to be evaluated according to developments. in the field and the legal challenges that arise. To increase the effectiveness of the ASEAN Treaty on Mutual Legal Assistance, it is necessary to make efforts to harmonize or approach differences in the legal systems of member countries, so that legal assistance procedures become more uniform and easier to understand.
