One aspect that must be considered in the BPD structure is the representation of women in terms of voting and being elected in accordance with the instructions of the Minister of Home Affairs and Perda that BPD membership must be filled by at least one woman and the election process must be carried out in a forum where women also have voting rights.
The main problem in this research is whether the practice regarding women's representation in terms of voting and being elected is in accordance with juridical regulations. This research is motivated by the fact that in Suka Jadi Village, Kuala Cenaku District, Indragiri Hulu Regency, the selection of members of the Village Consultative Body (BPD) Representation Women in Suka Jadi Village don't do it in women's forums, they only do it in men's forums. It seems that this has become the habit of every period. Why this practice occurs is what prompted this research.
This research is classified as sociological legal research. namely research that wants to look at the correlation between law and society with the gap between dass sollen and das sein. Meanwhile, judging from its nature, this research is a complete, detailed and clear description of reality. This research was conducted in the Suka Jadi Village area, Kuala Cenaku District, Indragiri Hulu Regency, while the population and sample were the Village Head, Village Secretary, Female Community Leaders, Chair of the BPD, Chair of the Election Committee. The data sources used are primary data, secondary data and tertiary data with data collection techniques using interviews and literature review.
From the research results, there are three main things that can be concluded. First, the Mechanism for Selection of Women's Representative BPD Members Based on Indragiri Hulu Regency Perda Number 3 of 2019 concerning the Village Consultative Body has the first stages of notification of the end of the BPD membership period, formation of a BPD member selection committee, selection of prospective members of the Women's Representative BPD, screening and determination of prospective members BPD representation of women. Second, the BPD Election for Women's Representatives in Suka Jadi Village is not in accordance with Indragiri Hulu Regency Regional Regulation Number 03 of 2019 concerning Village Consultative Bodies which are technically regulated in Perbup Number 89 of 2019. The discrepancy lies in the Voting Stages, in fact in Suka Village So the effectiveness of the law was not adhered to which in the BPD election for women's representation did not involve women's forums in the election of BPD for women's representation. Third, obstacles in the mechanism for selecting members of the BPD representing women in Suka Jadi Village in 2020 are still encountered, namely: First, lack of socialization, confusion in determining area designation, lack of participation from local residents, registration of prospective members of the BPD representing women, almost all prospective candidates register themselves at last minutes.
