Peran United Nations High Comissioner For Refugees (Unhcr) Dalam Menghadapi Kebijakan Australia Terhadap Pencari Suaka Transit Di Indonesia
Australia is a state party to the 1951 refugee convention since July 2, 1951, which makes Australia must accept refugees and asylum seekers whose status has been confirmed by UNHCR. However, this is contradicted by the turn back boat policy issued by Tony Abbott during his reign in 2013-2015. The turn back boat policy has repatriated a total of 79,000 asylum seekers who transited Indonesia in that year.
The method used in this research is a qualitative method collected from various sources, such as books, scientific journals, news articles and also official websites related to the problem under study. The theory used by the author is the role theory by Teuku May Rudy with two indicators; 1.) the role of international organizations as a means of negotiation; and 2.) the role of international organizations as independent institutions.
The conclusion of this research is that UNHCR has performed its role as a provider of negotiation facilities for Australia and Indonesia, namely through the Bali Process, 2014. The Bali process succeeded in making the turn back boat policy accept 544 asylum seekers from Indonesia. UNHCR has also carried out its role as an independent institution also seen from its impartiality to Australia and Indonesia in this case.
