Perlindungan Hukum Pengguna E-Wallet Aplikasi Dana Terhadap Kerugian Atas Pemotongan Saldo Otomatis
Electronic wallets are a means of transaction that is very influential in digital development. Dana is a payment system service in the form of electronic money, electronic wallets, fund transfers and other mobile-based supporting services that can be used via telecommunications devices. The problem that is often complained about by e-wallet users is that electronic wallet parties often ignore the rights of consumers here, in this case there is a delay in providing compensation to customers who should have received it. The problem currently experienced by fund users is that the balance is automatically deducted from paying the bill. it's not clear where the bill comes from.
The purpose of writing this thesis is: first, to find out Legal Protection for Funds Electronic Wallet Users Against Automatically Deducted Balances. Second, to find out legal measures that can be taken for losses suffered by users due to automatic balance deductions in electronic wallets. The research method in this thesis uses normative juridical research, namely research that focuses on examining the application of rules or norms. in positive law. The nature of this thesis research is researchdescriptivewhich systematically describes the facts and characteristics of the object being studied accurately. The data source used is the data sourcefirst, seconds andtertiary, The data collection method used in this research is firstly literature study, which is a technique for obtaining secondary data through documents related to the problem, objectives and benefits of the research, then after the data is collected it is then analyzed to draw conclusions.
Based on the research results, Legal Protection for Fund Electronic Wallet Users Against Automatically Deducted Balances, namely the first is preventive legal protection. Bank Indonesia Consumer Protection, funds are prohibited from making standard clauses that limit liability and if consumers experience automatic balance deductions in the electronic wallet system which causes losses to the user. have the right to receive compensation, secondly, repressive protection. Users of the application and those who experience automatic balance deductions who experience losses in order to get it back can take complaint action for resolution to Bank Indonesia, to dispute resolution bodies and the courts, both legal remedies. Consumers can sue business actors with institutions. who work to handle disputes between consumers and business actors, can resolve consumer disputes either in court or outside court
