The 1945 Constitution (UUD 1945) as one of the fundamental norms which must be used as a guide or reference, we must be able to see how to interpret each chapter, article or paragraph contained therein. So that we can draw conclusions about the rights and obligations of the state or society. One of them is the conclusion about the relevance of the 1945 Constitution, especially Article 28G paragraph 1 with the right to privacy of the Indonesian people. This also intends to look at the condition of Indonesia, where lately a person's right to privacy seems to have no limits or protection for his privacy. The word relevance itself contains the meaning of compatibility, connection, or harmony, especially in seeing the relationship between the right to privacy and Article 28G paragraph 1 of the Constitution.
The purpose of this research is to find out the substance of the regulation of privacy rights and to find out whether the protection of privacy rights in Law No. 19 of 2016 concerning ITE is in accordance with the 1945 Constitution and also see the appropriate form of protection of privacy rights.
This research is normative legal research, because it is based on library research that takes excerpts from reading books, literature, or supporting books that have to do with the problems to be studied assisted by primary, secondary and tertiary data sources. This research uses qualitative data analysis and produces descriptive data.
From the results of the research, it is concluded that, First, the regulation of the substance of the right to privacy in the 1945 Constitution is indeed not explained in detail in it. However, if seen from how we describe the contents of Article 28 G of the 1945 Constitution, it can be considered as a form of protection of one's right to privacy that is conveyed in general so that the government needs to make a law on the right to privacy. Second, seeing how this ITE Law, which has been in effect since 2008 and has only been revised once in 2016, it is necessary for the government to revise it again by looking at the aspects that affect it, especially in Article 27 paragraph (1), (3), Article 28 paragraph (2) and Article 29, because these articles are labeled as rubber articles. Third, the form of protection of privacy rights in accordance with the 1945 Constitution is the protection of privacy rights made in accordance with the mandate and content of the 1945 Constitution and also looks at other aspects that live and develop in society. The author's suggestions are, First, it is hoped that the government can make special regulations that discuss this right to privacy. Second, it is hoped that the government will revise several rubber articles contained in Article 27 paragraph (1), paragraph (3), Article 28 paragraph (2) and Article 29. Third, it is hoped that during the formation of this special bill on privacy rights to include supervision of the collection of individual personal data.
