Penegakan Hukum Terhadap Pencemaran Laut Akibat Meledaknya Kilang Minyak Montara Di Laut Timor Nusa Tenggara Timur Milik Ptt Exploration And Production Di Australia
Many countries overexploit without paying attention to the sustainability of the sea and the resources within it. In addition, measures to preserve and protect the marine environment are often ignored and not implemented optimally. Actions of this kind not only harm the country concerned, but also other countries located around the country concerned. The Montara Oil case which occurred in the Timor Sea also had an impact on Indonesian territorial waters, especially in the East Nusa Tenggara Province. It's just that PTTEP Australia, based on partnership research with several universities in Australia, stated that the impact of the Montara Oil Case did not have a negative impact on Indonesian waters, such as damage to marine ecosystems or marine biodata whose lives were threatened due to the pollution that occurred, as well as affecting the livelihoods of marine fisheries. fishermen have been hampered by the pollution caused by the explosion of the Montara oil refinery, of course this must be resolved as quickly as possible and there must be an international resolution to this case so that it does not result in greater losses.
This research uses normative juridical research methods sourced from literature studies with an examination of statutory regulations. And the results of this research show the application of international maritime law and law enforcement in the Montara oil case
The results of this research are: First, International Environmental Law states that every country has the right to exploit and utilize its country's resources, but it needs to be taken into account that these activities should not harm other countries such as pollution. Second, the pollution carried out by PTT Exploration and Production with the explosion of the Montara oil refinery, according to International Environmental Law, means that compensation must be made by the party who committed the pollution to the injured party or country so that the principle of Good Neighborliness between countries is created.
