The problem of holding multiple civilian positions by members of the TNI and POLRI has given rise to many pros and cons. Various reasons were put forward, such as the right of the TNI and POLRI to take part in determining the future of the Indonesian nation, the accumulation of non-job TNI and POLRI officers, to the government's direct policy of requiring active TNI and POLRI members who have competence to occupy civilian positions. The formulation of the problem in this research is first, how are dual positions regulated in statutory regulations? Second, what are the legal implications of holding dual positions in the TNI and POLRI in Indonesia? Third, what is the ideal concept of prohibiting multiple positions in Indonesia?This research was conducted to determine the regulation of multiple positions in statutory regulations, the legal implications of dual positions in the TNI and POLRI in Indonesia and the ideal concept of prohibiting multiple positions in Indonesia.
This type of research is classified as normative legal research. In normative legal research, the data source is secondary data consisting of primary legal materials, secondary legal materials and tertiary legal materials. Collecting normative legal research data uses data collection techniques using library research. Data obtained through literature study will be analyzed qualitatively. In drawing conclusions the author uses a deductive thinking method, namely a way of thinking that draws conclusions from a general statement or proposition to a specific statement.
Based on the research results, it can be understood that statutory regulations prohibit TNI and POLRI holding concurrent positions as commissioners in BUMN, which is based on concerns about conflicts of interest inherent in the TNI and POLRI, the implications arising from the appointment of the TNI and POLRI as Commissioners in BUMN, in accordance with regulations. laws are violated, the relevant party must be dismissed or resign from his position and the ideal concept of multiple positions in Indonesia must be regulated in the constitution so that the practice of holding multiple positions cannot be implemented, therefore, ethical values must be made into constitutionally binding rules, so that the practice of holding multiple positions no longer occurs in state administration
