Kedudukan Surat Keterangan Ganti Rugi (Skgr) Sebagai Bukti Kepemilikan Hak Atas Tanah Menurut Hukum Agraria Indonesia (Studi Putusan Mahkamah Agung Nomor 178 Pk/Pdt/2021)
Certificate of Indemnity (SKGR) which is a sign of ownership of the land or better known as a land certificate which is also an object in this land sale and purchase agreement, where the delivery of SKGR after the completion of payment. The delivery of SKGR which is a proof of ownership of the land is the seller's obligation at the time of the birth of the agreement and the item is controlled by the buyer when all payments have been completed. In the area of Riau Province, where most of the area has the status of State Land, in terms of obtaining Land Rights, it can be done by requesting the issuance of a Certificate of Indemnity (SKGR) first as proof of physical control of the land, which is then used as the basis for applying for the issuance of a certificate as proof of ownership of land rights.
The type of research used by researchers is normative legal research. Normative legal research is legal research conducted by examining library materials or secondary data. Normative legal research uses normative case studies in the form of legal behavior products, for example examining laws. So that normative legal research focuses on the inventory of positive law, legal principles and doctrines, legal discovery in cases in concreto, legal systematics, the level of synchronization, comparative law and legal history.
The results of this study are two things that can be concluded First, the Certificate of Indemnity (SKGR) includes land that has not been certified. Besides that, this also happened because of the expansion of the area both villages and sub-districts due to the increase in population and the development of development. Second, Judging from the legal strength of the SKGR proof, it is indeed not as strong as an authentic deed, but because the SKGR is a letter categorized as the basis of rights or juridical data on land which is used as a requirement for the completeness of the requirements for land rights applications as stipulated in the provisions of land legislation. The author's suggestion, to the authorized officials, is the need for the intervention of the authorized officials in order to resolve and all transfers of ownership rights to land because buying and selling must comply with the rules and procedures regulated or mandated by the enactment of the law. So all transfers of land ownership rights due to sale and purchase must be registered with certified or unregistered.
