The 1945 Constitution of the Republic of Indonesia (UUD 1945) gives quite a lot of authority to the President. One of its authorities is to determine "compelling matters of urgency", because the country is not always in a normal/peaceful/stable condition. In the opposite situation, the President as head of state is constitutionally given the authority to determine a situation of danger in the form of a Presidential Decree (Keppres). This research was conducted to determine the validity of the formation of the Presidential Decree of the Republic of Indonesia Number 12 of 2020 concerning the Determination of the Non- Natural Disaster of the Spread of Corona Virus Disease 2019 as a National Disaster and the Determination of the status of the non-natural disaster of the spread of Corona Virus Disease 2019 as a national disaster.
This type of research is classified as normative legal research. In normative legal research, the data source is secondary data consisting of primary legal materials, secondary legal materials and tertiary legal materials. Collecting normative legal research data uses data collection techniques using library research. Data obtained through literature study will be analyzed qualitatively. In drawing conclusions the author uses a deductive thinking method, namely a way of thinking that draws conclusions from a general statement or proposition to a specific statement.
Based on the research results, it can be understood that the formal and material requirements for the formation of Presidential Decree Presidential Decree Number 12 of 2020 concerning the Determination of Non-Natural Disasters for the Spread of COVID 19 as a National Disaster can be declared valid and the Determination of the spread of Covid 19 as a disaster is contained in Presidential Decree (Keppres) No. 12 of 2020 concerning Determining Non- Natural Disasters from the Spread of Corona Virus Disease 2019 (Covid-19) as National Disasters in accordance with Article 7 paragraph (1) letter c of the Disaster Management Law, which has the authority to determine the status of national and regional disasters is the government. Normatively, Normatively, determining the status and level of a disaster should be determined based on the indicators mandated by Law no. 24 of 2007 Article 7 Paragraph (2) letter c which mandates the establishment of a Presidential Decree containing indicators in determining the level of disaster, but to date the mandated presidential decree has not been stipulated. indicators that include the number of victims, property losses, damage to infrastructure and facilities, the extent of the area affected by the disaster, and the socio-economic impacts caused.
