Analisis Yuridis Putusan Mahkamah Konstitusi Nomor 103/Puu-Xx/2022 Atas Pengujian Materil Undang-Undang Nomor 7 Tahun 2020 Tentang Perubahan Ketiga Atas Undang-Undang Nomor 24 Tahun 2003 Tentang Mahkamah Konstitusi
The Constitutional Court is the implementer of the judicial branch of power (judiciary) which is independent and separate from other branches of power, namely the government (executive) and representative deliberative institutions (legislative). The dismissal of Judge Aswanto is an example of a form of intervention carried out by the Legislative institution against the Judicial institution, because the dismissal was caused because Judge Aswanto often annulled laws drafted and passed by the Legislative institution. The aim and purpose of this writing is to find out the legal considerations of Constitutional Judges in giving decisions regarding material review of Law Number 7 of 2020 concerning the Third Amendment to Law Number 24 of 2003 concerning the Constitutional Court and to find out the juridical implications of the Constitutional Court's Decision Number 103 /PUU-XX/2022 Regarding the Existence of Constitutional Judges as Independent Institutions.
The type of research used is Normative Legal research using a statutory approach method with data collection techniques using the literature review method.
From the results of the problem research, there are two main things that can be concluded: first, the judge's consideration in giving the Constitutional Court decision Number 103/PUU-XX/ 22, namely based on the provisions of Article 24 C paragraph (1) of the Constitution of the Republic of Indonesia Year 1945 which states that the Constitutional Court has the authority, among others, to adjudicate at the first and last instance whose decision is final to test the Law against the 1945 Constitution. Second, the juridical implications of the Constitutional Court Decision Number 103/PUU-XX/2022 on the existence of constitutional judges as independent institutions can undermine the independence and integrity of the judiciary. If a judge is dismissed or appointed only on the basis of political interests or the interests of a particular group, then the independence of the judiciary can be compromised. This can raise public doubts about fair legal processes and can reduce public trust in the judiciary.
