Perbandingan Konstitusi Antara Indonesia Dengan Venezuela Terkait Dengan Masa Jabatan Dewan Perwakilan Rakyat
Indonesia and Venezuela are two countries that have different legal systems (Indonesia adheres to a continental legal system while Venezuela adheres to a social legal system). However, Indonesia and Venezuela have similarities in the government system, namely presidential. The Indonesian Constitution in terms of the period of office of the DPR does not provide an explanation for how long and how many times the DPR can serve again, as well as the laws and regulations relating to other DPRs, whereas Venezuela clearly regulates this in its constitution. The aim of writing this thesis is first, to find out what the legal regulations are regarding the term of office of the DPR in Indonesia and Venezuela. Second, to find out the advantages and disadvantages of legal regulations regarding the term of office of the DPR in Indonesia. Third, to determine the contribution of legal regulations related to term limits for the Venezuelan National Assembly in strengthening term limits for the DPR in Indonesia.
This research is normative legal research. This is based on library research which takes quotations from reading books or supporting books related to the problem being studied. This research uses secondary data sources consisting of primary, secondary and tertiary legal materials. This research also uses qualitative data analysis and produces descriptive data.
Based on the research results, there are differences in the term limits for the Indonesian DPR and the Venezuelan National Assembly. In Indonesia, the periodization of the DPR is not regulated at all in the 1945 Constitution or special laws. Meanwhile, in Venezuela, the periodization of the National Assembly is clearly written in the 1999 CRBV which states that the National Assembly only lasts for two terms. This limitation of power in terms of periodization is important because in implementing a democratic state there are principles that must be fulfilled by limiting the term of office of the DPR. So, researchers hope that in the future, policy makers will create legal politics regarding the rules limiting the term of DPR members by changing the provisions governing the term of office of DPR members.
