Pengaturan Informasi Nutrigrade Dalam Pemenuhan Hak Konsumen (Perbandingan Hukum Indonesia Dan Singapura)
Consumer error in consuming over-the-counter food and beverages will contribute to poor health, whereas consumers need to be given the right to choose healthy food and beverages for them. However, consumer protection has not been able to provide legal benefits when associated with the right of consumers to choose healthy food and beverages through a clear and measurable category, such as nutrigrade. Therefore, the research objectives of this thesis, namely First, to analyze the comparison of nutrigrade information in fulfilling consumer rights in Indonesia and Singapore, Second, to explain the regulation of nutrigrade information in Indonesia and Singapore. This type of research can be classified into normative juridical research, using primary, secondary and tertiary legal materials. The collection of legal materials in this research uses a literature review method through a computerized filing system in the form of legal materials. Then the analysis of legal materials is carried out thoroughly and is a unity (holisctic), starting from inventorying laws and regulations related to the problem under study, then systematized and interpreted. From the results of the research there are two main problems that can be concluded. First, the comparison of nutrigrade information in the fulfillment of consumer rights in Indonesia and Singapore by using comparative law as a method, namely comparing from the aspect of institutions or concepts that are typical and substantial. The authority of food labeling is the authority of the Food and Drug Administration, while in Singapore it is the authority of the Singapore Food Agency. Then from the aspect of substance in Indonesia only regulates the Front of Pack nutrition label aimed at improving consumer understanding in interpreting nutritional values on the label, while in Singapore it has regulated nutrigrade information so as to help consumers identify drinks that are higher in sugar and saturated fat and to reduce the influence of advertising on consumer preferences, thereby encouraging more informed, healthier choices, and encouraging industry reformulation. Second, the regulation of nutrigrade information in Indonesia currently has no legal basis. Although there is an arrangement that comes close only to regulating Front of Pack (FOP) Nutrition Labeling, it is clearly not nutrigrade information. Unlike Singapore based on the Sale of Food Act 1973/Sale of Food Act 1973 as amended through the Food (Amendment No. 2)/Food Amendment No. 2 Regulations 2021 so that it firmly regulates nutrigrade information.
