Perlindungan Konsumen Terhadap Tanah Yang Bersengketa Di Perumahan Villa Tanera Kota Pekanbaru
One of the basic human needs is the need for shelter. The need for shelter or shelter is a need that cannot be separated from humans as a place to live or for shelter. Land as part of the earth's surface is an indicator of people's welfare and prosperity. In order to exercise its authority to regulate control of land by the people, the government is expected to be able to provide certainty regarding the ownership and control of the earth's surface by the people in order to achieve the greatest welfare and prosperity of the people. This research aims to find out what consumer protection and responsibilities of the PT Mandevilla Housing developer are for land in dispute based on Undang-Undang Nomor 8 Tahun 1999.
This research uses sociological legal research, where researchers approach the influence of non-legal factors on the formation of positive legal provisions. Data collection was carried out using a non-structured interview method, where later respondents were free to provide answers regarding PT Housing Consumer Protection. Mandevilla Against Disputed Land. Data analysis is carried out qualitatively, that is, the researcher will describe descriptively the data obtained. In drawing conclusions the researcher uses an inductive thinking method, namely a statement or proposition that is specific in nature into a statement or case that is general in nature.
The findings of this study indicate that the land dispute in Villa Tanera Housing has raised concerns about the developer's compliance with rights and responsibilities towards homebuyers. The developer of Villa Tanera Housing has a clear obligation to ensure that the properties they sell are free from legal issues, including land disputes, and to provide compensation to consumers in accordance with Article 19 of the Consumer Protection Law in case of losses. Consumers have the right to obtain compensation in various forms such as refunds, property replacements, or other forms of compensation, but as of now, the obligation to provide compensation has not been fulfilled because actual losses have not occurred. If the developer fails to fulfill their obligations, they could potentially face serious legal claims, underscoring the urgency and importance of their responsibility in promptly and fairly resolving this land dispute.
