Eksistensi Badan Permusyawaratan Desa Dalam Pembentukan Peraturan Desa Berdasarkan Peraturan Perundang-Undangan Di Desa Gunung Kecamatan Gunung Toar Kabupaten Kuantan Singingi
In Law Number 6 of 2014, the form of village government consists of the Village Government and the Village Representative Body where the Village Government consists of the Village Head and village officials (village secretary, village treasurer, section head and hamlet head). The Village Consultative Body is an institution that carries out government functions whose members are representatives of the village population based on regional representation and are determined democratically. The Village Consultative Body is an institution that monitors the implementation of village regulations and provides opportunities for the Village government to improve community welfare. Village Regulations are all Village Regulations stipulated by the Village Head after deliberation and approval from the Village Consultative Body. Guidelines for drafting Village regulations are regulated in the Ministry of Home Affairs Number 111 of 2014 concerning Technical Guidelines for Village Regulations. The preparation and development of village regulations by the BPD must pay attention to the stages properly and be carried out taking into account the interests of the community, including the preparation of village regulations in Gunung Village, Gunung Toar District, Kuantan Singingi Regency. The case encountered by the author was that the BDP was not running effectively because the duties and functions of the BPD were not running well. Because for approximately 4-5 years after the formation of the BPD there was no visible performance that was carried out well and there was no breakthrough in creating a Village Regulation. The aim of this research is to determine the existence of the BPD in the Formation of Village Regulations, what inhibiting factors hinder the Village Consultative Body in forming Village Regulations, and look for efforts if there are problems in the process of forming village regulations in Gunung Village, Gunung Toar District.
The type of research that will be carried out is sociological, which means reviewing the situation of problems in the field in relation to the legal aspects that apply and regulate these problems. Because in this research the author directly conducted research at the location or place being studied in order to provide a complete and clear picture of the problem being studied. The research was conducted in Gunung Village, Gunung Toar District, Kuantan Singingi Regency. The population in this study included the Village Head, Village Apparatus, Chair of the Village Consultative Body, members of the Village Consultative Body, and village communities. The data collection technique used was through direct observation and interviews.
From the results of research that has been carried out, the existence of the Village Consultative Body in carrying out the formation of Village Regulations has not been fully implemented, due to the lack of understanding of the Village Consultative Body regarding its function in forming Village Regulations. There are several factors that hinder the formation of village regulations, including BPD members' lack of understanding regarding the formation of village regulations, BPD members not understanding their main duties and functions properly, resource factors, innovation, and facilities and infrastructure.
