The conditional death penalty aims to provide opportunities for convicts to rehabilitate themselves and change for the better. The conditional death penalty also aims to reduce the risk of execution of innocent people, demonstrate a humanist attitude and respect human rights, and accommodate various conflicting views and interests regarding the death penalty in Indonesia. The conditional death penalty is regulated in Article 100 Paragraph of Law Number 1 of 2023 concerning the Criminal Code.
The type of research that will be carried out is normative legal research. From the perspective of its objectives, normative legal research can be divided into 7 (seven) types, namely in this case research is carried out on legal principles, namely regarding the Application of the Conditional Death Penalty Law in Law Number 1 of 2023 concerning the Internal Criminal Code. Legal Certainty Perspective.
Based on the results of the research and discussion, it can be concluded. First, 1. The urgency of the conditional death penalty in Law Number 1 of 2023 concerning the Criminal Code is not separated from the differences in views of the death penalty between Retensionists and Abolitionists. The conditional death penalty law is a criminal concept that gives death row inmates the opportunity to receive pardon from the President after serving a probationary period of 10 years, with certain conditions. This concept is regulated in Article 67 of Law Number 1 of 2023 concerning the Criminal Code (KUHP), which states that the conditional death penalty is a special crime and is always alternatively threatened with life imprisonment or a maximum prison sentence. 20 years. Second, the granting of conditional death sentences in Law Number 1 of 2023 concerning the Criminal Code is linked to the principle of legal certainty where Article 100 paragraph 4 of the Criminal Code can be criticized if you look at the phrase "can", which creates uncertainty. It is possible that the phrase "can" indicates that changing the death penalty to life imprisonment is not a definite right for the convict, but rather a discretionary authority for the President, who can grant or not grant such a change to the penalty.
