Implementasi Pembuatan Akta Kelahiran Anak Dari Pernikahan Tidak Tercatat Di Kota Pekanbaru
The number of cases of unregistered marriages in Pekanbaru City includes one case where a couple, who had previously been legally married and had children, later conducted a siri marriage with someone else. This issue highlights both legal and social problems associated with the practice of siri marriage. Based on the findings of the preliminary research, problems arise in the issuance of birth certificates for children born to unregistered marriage couple. This research aims to examine how birth certificates are issued for children from unregistered marriages in Pekanbaru City and identify the factors that inhibit the process. The researchers conducted interviews, observations, and documentation to collect data and analyze it, aiming to understand the process of issuing birth certificates for children from unregistered marriages in Pekanbaru City and the challenges involved. This research uses the theory of Van Meter and Van Horn (Kurniawan and Maani), which includes six indicators: implementation activities, inter- organizational communication, characteristics of the implementers, clear policy objectives and standards, economic, social, and cultural conditions, and available resources. The results indicate that the process of issuing birth certificates for children from unregistered marriages in Pekanbaru City is not being carried out optimally, particularly in terms of implementation and inter-organizational communication, as well as financial resources. In some cases, birth certificates for children have been issued in ways that do not follow the standard operating procedures (SOPs), and there is a lack of communication between organizations, resulting in no cooperation to address the issue of unregistered marriage, which affects children's rights, especially their civil rights. DISDUKCAPIL and the Religious Courts could collaborate with the government through the Office of Women's Empowerment and Child Protection and the Community Empowerment Office to carry out socialization and make budget-efficient efforts to support these activities.
