Pelaksanaan Perlindungan Konsumen Dalam Jual Beli Mobil Bekas Di Showroom Syahran Motor Kabupaten Padang Lawas Sumatera Utara
ABSTRACT
Indonesia is trying to provide consumer protection by means of one of
them, namely forming Law No. 8 of 1999 concerning Consumer Protection. This
study examines specifically the protection of consumers buying and selling used
cars at the Showroom which is located at Jl. Kihajar Dewantara Lingkungan VI,
Kec. Barumun, Kab. Padang Lawas, North Sumatra called Syahran Showroom
where researchers examine the fulfillment of consumer rights in the used car sale
and purchase agreement between business actors, namely Syahran Showroom
and consumers. Researchers also examined the Used Car Sale and Purchase
Agreement at Syahran Motor Showroom, Padang Lawas Regency, North Sumatra
between the parties (Showroom) and consumers. The purpose of this study is to
find out specifically related to the implementation and constraints of consumer
protection in buying and selling used cars at Syahran Motor Showroom and to
find out the efforts that have been made by consumers to obtain legal protection
for the losses suffered by consumers.
This research is a Sociological legal research, this is based on field
research that refers to interview and observation information and supporting
documents that have a correlation with the background of the problem to be
studied. This research uses secondary data sources consisting of primary,
secondary, and tertiary legal materials.
Conclusion The application of consumer protection law in the sale and
purchase of used cars in the Showroom syahran motor is not in accordance with
the application of consumer protection laws as evidenced by the fact that there
are still many consumer rights mandated by Article 4 of the Consumer Protection
Law that are not fulfilled by business actors to consumers in the Showroom
syahran motor and there are still obstacles in consumer protection for buying and
selling used cars in the Showroom syahran motor as evidenced by the fact that
there are still consumers from the Showroom syahran motor who experience
losses and lack of detailed information related to used cars sold by business
actors and have violated Article 7 letters b and f. Suggestions There is a need to
increase legal knowledge about consumer protection to business actors and
consumers to minimize the losses that will arise both for business actors and
especially for consumers and consumers should need to make further efforts to
claim back their rights to business actors through the Consumer Dispute
Resolution Agency.
