Mediasi Penyelesaian Sengketa Tanah Di Desa Kinali Kabupaten Kuantan Singingi
ABSTRACT
Land disputes are common problems in rural areas, including in Kinali Village. These conflicts are generally caused by overlapping ownership rights, unclear land boundaries, and weak land administration. One of the settlement efforts taken is through mediation, which is a non-litigation dispute resolution process involving a neutral third party. This research aims to determine the role of mediation in resolving land disputes in Kinali Village, as well as to identify the inhibiting factors in the mediation process.
Research methods are an essential factor in producing scientifically accountable academic work so that the results can approach actual truth. Legal research is carried out to develop the law and respond to new legal issues that arise in society. Without legal research, legal development will not be optimal. The author uses a type of sociological or empirical legal research. Sociological research is research on law by observing the characteristics of community behavior in a certain region within an aspect of social life. This research was conducted in Kinali Village, Kuantan Singingi Regency.
Research findings indicate that mediation in Kinali Village is quite effective in resolving land disputes, as it emphasizes deliberation, kinship, and local wisdom. Mediation facilitated by the village government and involving traditional leaders has proven effective in diffusing conflicts, accelerating the resolution process, and maintaining social relations among residents. However, the mediation process also faces several challenges, such as the community's limited understanding of mediation procedures and the limited capacity of mediators. The success of mediation is influenced by the neutrality of the mediator, the openness of the parties involved, and respect for local values. Nevertheless, obstacles remain, such as the lack of formal documentation of mediation outcomes and limited legal understanding among the parties. Therefore, it is necessary to enhance the capacity of village officials in mediation techniques, along with regulatory support that recognizes the legal strength of village mediation outcomes.
