One of the important points in the bureaucratic simplification program is the simplification of echelons through the elimination of structural positions at the administrator and supervisor levels, replaced with functional positions. The process of eliminating existing structural positions with a policy of equalizing positions into equivalent functional positions is not immediately easy to implement by the National Narcotics Board (BNN), because the elements that fill structural positions in the Organizational Structure and Work Procedures (SOTK) of the BNN are also filled by personnel of the Republic of Indonesia Police who are seconded to the National Narcotics Agency with the placement of personnel according to their respective fields of expertise and in accordance with applicable regulations, both BNN regulations and Police regulations. Therefore, it is necessary to examine the mechanism for appointing Police personnel to functional positions of state civil servants at the National Narcotics Board.
This research aims to examine juridically the mechanism for appointing members of the Republic of Indonesia Police to functional positions in the state civil apparatus at the National Narcotics Board. This research uses normative research methods using primary data as a data source. The data obtained by the author was from primary legal materials consisting of applicable laws and regulations to find solutions to problems and then the data was analyzed descriptively qualitatively.
The results of this study indicate that the mechanism for appointing members of the Republic of Indonesia National Police to functional positions of state civil servants at the National Narcotics Board is not problematic in the process and mechanism stages, however what hinders the mechanism is the related norms and regulations that have not provided legal certainty. This is because there are no regulations regarding the determination of job titles, job competencies, and ASN job requirements that can be filled by members of the TNI and Polri accompanied by the approval of the relevant Minister in accordance with Government Regulation Number 11 of 2017 concerning Civil Servant Management.
