Pelaksanaan Pemenuhan Kewajiban Alimentasi Anak Terhadap Orang Tua Lanjut Usia (Lansia) Di Kota Pekanbaru
ABSTRACT
Alimentary rights, or the right to receive support and sustenance, hold
profound significance for the elderly. These rights are rooted in humanitarian
principles. Every individual, regardless of age or physical condition, has the right
to a decent and dignified life. Older adults, who may face physical, health, or
economic limitations, often constitute a vulnerable group. Alimentary rights ensure
that they are not neglected in their twilight years, and that their basic needs—such
as food, shelter, clothing, and healthcare are adequately met. Allowing the elderly
to live in poverty or neglect constitutes a violation of fundamental human values
and diminishes their dignity as individuals. The purpose of this research is to
examine the implementation of the fulfillment of alimentary rights for elderly
parents in the city of Pekanbaru and to explore the role of the family in influencing
children's compliance with their alimentary obligations toward elderly parents in
the same city.
This research employs a sociological (empirical) approach. The sociologicalempirical
method involves examining legal issues based on the realities and
conditions existing within society. This approach was chosen because the
researcher directly conducted fieldwork at the research location and analyzed a
case derived from a pretrial decision to provide a comprehensive and clear picture
of the issue being studied.
The findings of this research indicate two key points First, the implementation
of the fulfillment of alimentary rights for the elderly in the city of Pekanbaru while
legally regulated in several provisions, such as Article 100 of the Indonesian Civil
Code (KUHPerdata), which obliges children to provide support to their parents in
need still faces many challenges in practical application Second, the role of the
family in influencing children’s compliance with their alimentary obligations
toward their elderly parents in Pekanbaru is crucial from moral, social, and legal
perspectives. The family serves as the primary foundation for instilling values of
filial piety, reciprocal justice, and intergenerational responsibility.
