Penerapan Sanksi Hukum Adat Terhadap Pelecehan Seksual Dalam Ranah Kekeluargaan Di Desa Sintong Bakti Kecamatan Tanah Putih Kabupaten Rokan Hilir
ABSTRACT
Customary law, as one of the recognized legal systems in Indonesia, regulates all matters concerning indigenous communities. Indonesia is undeniably a country with diverse ethnicities and cultures, even predating the introduction of conventional law. This study examines the application of customary law sanctions to acts of sexual harassment that occurred in Sintong Bakti Village, Tanah Putih District, Rokan Hilir Regency. This type of case is resolved through customary law mechanisms passed down through generations. This study aims to determine the family resolution process and how customary law sanctions are applied to sexual harassment.
This research used empirical legal research, i.e., fieldwork. It is descriptive in nature. The research approach was qualitative. Data were obtained through direct interviews with customary leaders, village officials, and the community, as well as observations of the customary case resolution process.
The results indicate that the case was resolved through customary deliberations led by customary leaders, involving families and village officials. The customary sanctions imposed generally took the form of monetary fines and customary apologies. This mechanism is viewed by the community as a way to maintain family harmony and social order.
The conclusion of this study is that customary law still plays a significant role in resolving sexual harassment cases in Sintong Bakti Village, although its implementation is not fully aligned with state law, which emphasizes deterrence and legal certainty. The research recommends that customary leaders maintain a fair deliberation mechanism, village officials support the customary dispute resolution process to ensure a more orderly process, and the local government provide legal guidance and counseling so that customary law can coexist with state law.
