Fixed-Term Employment Agreement (PKWT) is a labor agreement between a
worker and an employer that governs the employment relationship for a specific
period or for certain types of work that are temporary in nature. PKWT is typically
applied to jobs that are expected to be completed within a specific timeframe, are
seasonal, or related to new products that are still in the trial phase. PT Pelabuhan
Indonesia (Persero) Medan has employed thousands of workers, including through
the PKWT contract system. As a state-owned enterprise (SOE), PT Pelabuhan
Indonesia (Persero) Medan is obligated to comply with all prevailing labor laws,
including the principles of fairness in human resource management. However, in
practice, there are still disparities in the implementation of labor rights for PKWT
employees. Therefore, the purpose of this research is to analyze the forms of legal
protection for Fixed-Term Employment Agreement (PKWT) workers who undergo
contract renewal and to examine the application of the principle of justice in the
fulfillment of labor rights for workers with Fixed-Term Employment Agreement
(PKWT) status at PT Pelabuhan Indonesia (Persero) Medan.
This study employs a sociological legal research method. Data collection
tools include interviews with PKWT workers and the Human Resources (HR)
Division. The data obtained in this study were analyzed using a qualitative
descriptive method. Conclusions were drawn using in-depth interviews, which is a
qualitative data collection method aimed at gaining a deep understanding of
respondents’ attitudes, knowledge, and perspectives through one-on-one openended
conversations.
The results of the study indicate that at PT Pelabuhan Indonesia (Persero)
Medan, there are PKWT workers who have been employed for more than five years
but remain under contract status, with no clear path to permanent employment.
Additionally, several normative rights such as annual leave, training, and social
security are not distributed equitably. The contract drafting process is also carried
out unilaterally without involving the workers. These practices not only cause
economic and social harm to workers but also reflect weak implementation of
justice principles in industrial relations.
The fulfillment of labor rights for PKWT employees at PT Pelabuhan
Indonesia (Persero) Medan requires stronger labor regulations and oversight. A
comprehensive evaluation of transparency, communication, and administrative
processes is necessary to ensure that the rights of PKWT workers are protected
fairly and sustainably.
