Peranan Lembaga Pemasyarakatan Kelas Ii A Kota Pekanbaru Dalam Membina Dan Menanggulangi Narapidana Tindak Pidana Pengulangan (Residivis)
ABSTRACT
Criminal Law is considered as ultimum remedium and also residues from other legal fields, after other legal fields are considered unable to resolve conflicts that arise in the community. In criminal law sanctions in the form of criminal sanctions are very strict, which can be in the form of a criminal body, a criminal offense of independence, or even a criminal offense. Everything is done in a prison house. Repetition of a crime is nothing new in the world of law, because where there is a crime there is also a repetition of crime and repetition of crime is considered as a continuation of evil intentions. Repetition or recidivism means a repetition of a crime or a criminal return which he used to do after being convicted and serving his sentence. It is evident that there are still many recidivists who still repeat their crimes again, because there is no deterrent effect on my guards themselves.
The purpose of this thesis, namely; First, to find out the implementation of prisoner formation especially recidivists at the Pekan Pekan Class II A Penitentiary. Second; To find out the factors that cause a person to become a recidivism in the Class II A Correctional Institution in Pekanbaru City. This type of research is sociological legal research that is in this study the author immediately conducted research on the location or place of the problem under study. Data collection techniques in this study were interviews, questionnaires, and literature studies.
The results of the research conducted can be concluded. First, the implementation of guidance for recidivists in the Class II A Correctional Institution in the City of Pekanbaru in fostering and overcoming recidivities, namely: 1. Personality / mental development. 2. Coaching skills. 3. Coaching education, of the three coaching is very important for perpetrators of criminal acts of repetition (recidivists) so that when they are free there is something they can hold to continue their lives better. Second, the factors that influence recidivist inmates do criminal prosecution again in Pekanbaru II Class II A Penitentiary Institution: 1. Lack of legal awareness for the perpetrators of the crime themselves. 2. Due to economic factors. 3. There is no cell separation between recidivists and non-recidivists. Author's suggestion, First, to optimize coaching and mentoring in Correctional Institutions is an effort to prevent the occurrence of criminal acts of repetition, of course coaching and proper treatment so that the objectives of the prison are reached. Second, to increase the awareness of recidivist prisoners to the law and to improve the quality of prison officers to be more maximal in providing better coaching, and to improve facilities and infrastructure for prison management, especially for recidivist prisoners.
