Tinjauan Kriminologis Terhadap Pelaku Tindak Pidana Pencurian Dengan Kekerasan Pada Lembaga Pemasyarakatan Kelas Iib Bangkinang
ABSTRACT
Violent theft is a crime that is rife in people's lives. Therefore, a consistent action that can enforce the law, so that harmony can be established, which in this case increases the theft with violence committed by various groups. This study aims to be able to see the factors of someone committing theft, in order to find out preventive and repressive actions that are in accordance with the purpose of the law. Factors that encourage a person to commit a theft are important to discuss in order to enforce the appropriate law and can help perpetrators who have internal factors (psychiatric) to be rehabilitated. The problem in this study is whether a person's criminological factors are committing a criminal act of theft with violence and whether the convicted person still commits the same crime in his daily life.
This study uses normative and empirical juridical approaches. Data obtained through literature study and through interviews using written guidelines against predetermined sources. This research was carried out at Bangkinang Class II B Penitentiary in 2019, with speakers consisting of the Head of Class II B Bangkinang Penitentiary and violent theft inmates at Class II B Bangkinang.
The results of the study and discussion can be concluded that the factors of someone committing a criminal act of theft with violence are various. In addition, that the law has not become a tool for full social control in Bangkinang Class II B Penitentiary, because there are a number of criminal offenders conducting the same crime in it. This has become a lesson for Bangkinang Class II Correctional Institution, that Lapas should be more able to provide detention for violent prisoners of theft. In addition, that the Class II B Penitentiary Bangkinang must present a psychologist to be able to provide therapy against perpetrators of theft with violence caused by disturbed psychiatric, namely Kleptomania.
